Child Support Tables are Hyper-inflated, Orders are Doubled

After much wrangling with SOW, the rapacious Child Support Tables and the  removal of Punitive measures for False Allegations were accepted by the Joint Senate-Commons Committee on Child Custody and Access for passage into Law, ON CONDITION that passed with it would be the Equal Shared Parenting Legislation.   We are told the thinking was that with Equal Parenting in place, the Child Support Tables would become insignificant.

The Liberal Government, however,  double crossed the Committee by splitting the compromised Bundle and and passing alone the Child Support Tables. while "tabling" the Equal Shared Parenting Legislation

What they should have done of course is to divide the difference by two, and Order the halved difference to be paid.  So every BC Child Support Order out there, it would appear is TWICE the amount that should have been Ordered from the fraudulent Tables, and the Dads should have a big Credit Balance at the FMEP which they should be able to demand returned to them with Penalties and Interest..

I read with interest the reasoning for the child support guidelines and how they came about.

They arrived at the cost of raising a child by figuring out the cost of a SINGLE person with respect to monthly costs and compared it with the living costs of an adult and 1 child.

The conclusion was $10,000 annual income supported one adult - which was equivalent to a $14,000 income needed to support 1 adult and 1 child at the same standard of living. The $4000 difference translated into $300 per month child support.

So, the cost of raising one child is $300 per month - and the non custodial (father) parent pays the entire amount!

But suppose the non custodial (N.C.) parent sees his child 30% of the time? (1 day per week and every second weekend) then the extra cost to the NC parent is $$1200 per year for food, shelter & necessaries.

This leaves the custodial parent with a windfall of ($4000 x 30% )= $1200 (the cost of the child to her is $4000 x 70% = $2800)

Therefore, the father's income level drops to (10,000 - 1200) = $8800 and the mom's income rises from the $10,000 'equivalent' amount to ($14,000 - 2800 ) = $11,200

So there is a $2400 difference in the disposable income available to the father and mother. And at an 'adjusted' income for the N.C parent of $8800 - this amounts to a 30% LOWER standard of living for the N.C. parent (2400 / 8800) as compared to the custodial parent.

NOW add to this $2400 bonus for the mother, ALL the tax advantages. In real terms, the $300 per month after tax child support means it ACTUALLY costs the father $400 (at a 25% income tax rate). That is he must earn $400 - pay $100 in tax and pay $300 in child support. The mother, does not pay tax on this amount so there is an additional money difference of $100 x 12 months = $1200 per year.

NOW we have $2400 + 1200 = $3600 / 8800 = 41% LOWER standard of living for the N.C. parent (the father).

We're not finished yet....the custodial parent (the mom) receives child tax credits (or family allowance) for the child as well.

When the dust settles, the child support guidelines result in the N.C. parent (the father) having a standard of living 50% lower than that of his ex-wife. Sound fair????
