Grandparents and Parents Chasing a Family Court Judge

Natural Grandparents' Rights Proposals

In addition to the Three Layers of Equal Parenting proposals for Natural Parents, we propose three objectives of Statutory Change for Natural Grandparents' Rights:

1. In the absence of a Natural Parent in a Custody proceeding, a Natural Grandparent may stand in the Natural Parents' stead as an Equal Parent.  That is, the Natural Parent's rights are immediately attributable to a Natural Grandparent if for any reason the Natural Parent cannot stand as an Equal Parent.

2. A Natural Grandparent may (and probably should) stand as a Co-Defendant in a Custody Trial with their child, the Natural Parent..

3. A Natural Grandparent standing as an Equal Parent in the absence of their child, the Natural Grandparent shall NOT be penalized for their kinship or blood tie to their Natural Grandchild in any application they may make for for Government assistance, grant, subsidy or other funding to defray their costs of child rearing which may be available to any unrelated Citizen who might take custody of the Child..

4. A Grandparent shall be offered Specified Access periods to be incorporated into the Parenting Timetable at the time of the Annual Parenting Supplement.  The minimum Specified Access of a Natural Grandparent which on request must be provided in a Parenting Timetable  shall be FOUR  Visitation Days (i.e. four twelve hour periods) per year per Natural Grandparent.  That is, for each pair of Grandparents, eight Visitation Days (twelve hour periods) per year shall be provided for in the Parenting Timetable by the Equal Parents.  If for convenience the Natural parents decide to leave the children with the Grandparent/s for baby-sitting or for a Visitation Overnight, these periods will NOT be considered part of the Visitation Days allotted to the Grandparent/s.  Each year, for convenience, a Natural Grandparent may waive rights for Specified Access.

5. In the absence of a Natural Grandparent, the Natural Grandparent's Rights of the absent Grandparent shall be immediately attributable to the present Natural Grandparent of the same pair of Natural Grandparents.
