"British Columbia MP Jay Hill, .. said he remains convinced that what he calls an “equal access to parents” presumption (as viewed from the child’s perspective) is essential to counter the gender bias in favour of mothers that Hill perceives in custody and/or access disputes. ..  He does not accept that joint custody .. promote strife. “I don’t buy it. I think it’s opposite,”  <Amen!> ..  “We presume, when a marriage is intact, that both parents are ‘good parents’ — why, in heaven’s name, when the parents split up, is there not a presumption they are both still good parents and that the child deserves access to both?” he queried.  “I fervently and passionately believe that it should be the right of a child to equal access to both parents, end of story, unless it’s not in their best interests,” he continued. “I have pressed for amendments to the Divorce Act to automatically grant ‘shared parenting’ in the case of divorce or separation, except in cases of abuse or neglect. . .or denigration of the other parent. On a personal level, that’s where I want the law to go, into the area of shared parenting as put forward by the 1998 joint Senate/House of Commons report For the Sake of the Children.”

Some of us attended the Joint Committee's Hearings on various occasions in the mid nineties.  At the beginning of a Meeting, a Panelist took the microphone and informed us that it was the Panel's duty to inform us that we Attendees had placed our lives at risk merely by attending the Meeting.  Our later enquiry with a Panelist revealed that numerous bomb and sundry threats had been made against the Meetings generally and that every Panelist had individually received numerous Death Threats personally, most especially, Senator Anne Cools.  On pressing for more information about who was making the threats, we were surprised to discover how animated and aggressive the Homosexual communities were about shutting down the push being made for Equal Parenting  generally across Canada.  The Panelist listed off a long list of groups that had made the personal and general threats.    (Apparently some of these groups murder people all time, but PC reporting will rarely allow the gore or the politically incorrect facts to be reported.  Let the Reader be warned. )  We had no idea at the time why the Homosexuals would be so concerned about shutting down Equal Parenting.  We had wrongly presumed them to be docile misfits deserving of a kind word  from the rest of us.

“I’m pushing for equality —both parents should have equal rights and equal access to their child,” Hill said. “The courts seem to start from the premise that somehow fathers aren’t responsible parents. But both parents are deemed good parents as long as the marriage lasts; why are they not when the marriage ends?”   

Jay has introduced Bill C-245, An Act to amend the Divorce Act (shared parenting)   This bill would ensure that courts grant custody of a child to both divorcing spouses unless there exists evidence that it would not be in the best interests of the child.  The bill includes the recommendations of the Joint House of Commons-Senate Subcommittee on Custody and Access which the Liberals have essentially shelved.
