Dear Steven,

While not all Federal Liberals are bad people and some such as Roger Gallaway,M.P., Paul Sazbo, M.P.(among others), and of course our "friend" in the Upper House, Senator Anne Cools are helpful countering discrimantory Family Law legislation...

Bill C-41 is indeed "Federal Legislation" affecting Family Law across Canada.

Bill C-41 was passed in 1997 in Ottawa under the direction of then Minister of Justice, The (not so) Hon. Alan Rock who today is the Federal Health Minister.

Bill C-41 grabbed an extra 4 Billion dollars per yer out of Non Custodial Parents pockets by making them pay income tax on "Child Support." All Child Support agreements that were formulated after May 1997 have the Custodial Parent receiving after tax Child Support cheques. Kind of like winning a lottery!

Bill C-41 also contains legislation enabling our Federal Government to withhold a Canadian Citizens Passport if they are in arrears on Support. The Federal Government ignores the fact that this unconstitutional.

Bill C-41, in my opinion is and still is, the most discrimantory piece of legislation aimed at Non Custodial Parents in our country's history.

Every Province in Canada has used the Federal Support Guidelines. These guidelines are claimed by many to be excessive including myself. They are not about what you can afford to pay, they are about what the "system" figures you should pay.

You may be thinking about recent draconian legislation passed in Ontario such as Bill 117. Bill 117 is also known as The Domestic Violence Act. Under Bill 117, a person can be "stripped" of all rights by a simple phone call. Once the call is made, an ex-parte order can be issued seizing such things as your home or apartment and your bank acounts and credit cards. Bill 117 steps over the boundary of provincial law into federal law despite this being claimed to be illegal by many. "That is why with have the Federal Criminal Code" is the argument heard.

I dislike most Federal Liberals because of their refusal to date to enact needed changes to The Divorce Act, and also because of Minister of Justice, Anne McLellan's refusal to enact the 48 changes recommended in the Joint House study called "For The Sake of the Children," which recommends "Shared Parenting Legislation" as the norm in divorce.

While the Canadian Alliance Party is presently in disarray due to questions about Stockwell Day's leadership, they have been vocal in supporting "Shared Parenting Legislation." More on this can be found on F.A.C.T.'s web site.

Below is a paste of a letter a friend received on Feb. 8, 2001 from the Leader of the Official Opposition, Mr. Stockwell Day, M.P. Send me your email if you wish a forward of this letter:

Dear XX XXXXX,

Thank you for your recent letter. I welcome this opportunity to respond to your concerns personally.

I have seen many cases of children suffering at the hands of a problem plagued justice system. We have been pushing Justice Minister Anne McLellan to impose critical reforms to the Divorce Act. Paul Forseth, Canadian Alliance M.P. for New Westminister, was a member of the Joint Committee on Child Custody and Access which travelled across the country gathering testimony from concerned citizens such as yourself. The Official Opposition made a series of contributions to the committee's report which Ms. McLellan continues to ignore. At the conclusion of the Committee, the Minister of Justice neglected to enact reforms to the Divorce Act desired by 77% of Canadians.

It is clear that when families break down, the needs and best interests of children must be the highest priority. Like you, we feel that children should not penalized when families are affected by divorce and other unfortunate circumstances. The Canadian Alliance will continue to press the Liberal government to take action before the May 1, 2002 deadline set by Justice Minister Anne McLellan.

I assure you that this issue is of critical importance to the Members of the Canadian Alliance. I appreciate your input, and thank you for sharing your concerns.
