Hal
was a Widower and had a daughter, Danica, from a previous marriage.
He then had two children with a new wife who left him when they were
toddlers. (She was reported to have taken up with her Courtenay
lawyer.) When our BC Family Courts put Hal
through
it's torments of Imputed Income,
Gleaned Wages,
State Imposed Homelessness,
and
Debtor's Prison, they imposed these same torments on his
daughter Danica, then a Tween. Hal points out the Support Tables
assume the only children to support are the Payee's children.

EVERY other weekend for the past four and a half years, I've spent
three precious days with my two adolescent daughters. We play tennis
in summer, ski in winter, travel when the school schedule allows.
But no matter where we are, we're all keenly aware of the thin
membrane of secrecy that keeps us from being as close as we were
before their mom and I divorced. <Equal

Like most divorced fathers, I'm caught in
exactly the kind of nightmarish situation that experts on stress say
to avoid a great deal of responsibility, but very little power.I'm
the major source of support for my children; my financial
obligations are set by the state, and my wages automatically
garnished. (If I lost my job tomorrow, and couldn't keep up with my
payments, a warrant for my arrest would be issued within two
months.) But my influence over how my daughters are being raised is
limited, sometimes by decisions their mother makes that I have no
input into, and sometimes by their allegiance to her when she and I
are at odds. ... They'll forget to tell me
some detail of their lives or downright lie if they have to so I
won't feel sad that I've missed something they shared with their
mom, or raise issue over some decision she's made with which I might
not agree. As a result, I sometimes come away from visits or phone
calls feeling shaken, saddened and angry. My ex and I
have been to court over support issues, and we've been to court over
custody issues, and the legal battles inevitably trap our children
in the middle and force them to choose sides. Sadly, this is exactly
what not to do if you want to foster a loving parent-child bond. In

The first step toward fostering a father and child reunion is to
make private mediation of the parenting provisions (physical
custody, legal custody and visiting) the standard procedure.
Allowing parents the chance to negotiate their support and
possibly give fathers more of a say in how their support is spent
will decrease the vitriol, and let fathers feel more like parents,
not just paychecks.
Second, we need to enact and enforce
sensible penalties for interfering with visits. Jailing a mother
is no way to solve the dispute; neither are financial penalties
that hurt her ability to care for the child. But mediation
perhaps compelled by the threat of financial penalty might be
the solution. It's estimated that one in five children of
divorce has not seen his or her father in the past year. Without
substantial rethinking of our current support and custody law,
children will continue to be alienated from their fathers, and
lawyers will remain on hand to soak up the resulting legal fees.

Just this month, I received a summons to attend a custody
conference at the Allentown, Pa., courthouse, and another letter
informing me that an accounting error has left me short on
support payments, and that my passport may be suspended. I want
to shield my daughters from these harsh truths. So these are the
secrets I'll be trying to keep from them as we gather together
for Father's Day. What secrets will they be keeping from
me?

Dad's fight for kids blocked at every turn, Sunday, January

"Mel Mabbott has been to court
52 times in his fight to remain a dad to his
kids....It's cost him $150,000 in legal bills
and $750,000 in lost wages and business deals.
He's sold his farm and his house and been
charged with abducting his own children."

I've got a little girl who is suffering with depression.
Jared has a hard time going to sleep at night because he's

"He said an investigation of his case is needed because
government incompetence has inflicted "huge" emotional
damage on his kids and has cost taxpayers hundreds of
thousands of dollars.

<Teresa Anne Howe,> described later in MINISTRY documents (which Mabbott finally
obtained through a court order) as
"frequently intoxicated,"
on "drinking binges" and having continuing "substance abuse
issues" -- has been in and out of hospital
psychiatric wards, detox and recovery programs with little
success".

but spent the summer of 1998 with their mom in BC on an
access visit."

Legal Aid, and
without Mabbott's knowledge (notice was not served on him)

children from an Alberta court, although no decision was
made on legal custody."

Ministry that the kids were being neglected, the ministry
insisted that the court's decision

return the children to mom. It was not until April 2000 that the ministry determined
that the children were at risk in their mother's care.
The kids were apprehended and placed in foster care".
"Meanwhile, said Mabbott, the ministry failed to inform him
that it had scooped the kids, despite the fact that they had

THE PROVINCE - VANCOUVER Sept., 2004, By Lena Sin Staff Reporter
"A B.C. Supreme Court order
that granted a man's ex-wife interim custody of
their three children was overturned yesterday
after four days of legal wrangling and evading
police. .. It was a happy conclusion for
Melvin Ronald Mabbott, 43, whose day began in
Victoria with an arrest. .. Both Mabbott and his wife,
Joan Elizabeth Thomson, 49, were arrested for
breach of a court order at about 10:45 a.m. by
sheriffs who'd been alerted about warrants
issued by
Williams Lake RCMP on Monday.
"We were
alerted that Ms. Thomson and Mr. Mabbott were in
the
courthouse and we were also alerted that
there
was a Canada-wide warrant out for them in
Williams Lake," said
Sheriff James Lee.
"They were here to make an application to have
an order set aside, and just because the
warrants were outstanding, I still had to
execute them."
Doug Christie, Mabbott's
lawyer, said the charge was stayed later
yesterday.
"He came
here to set aside a court order, but that's not
breaching it," said Christie.
The legal feud began Sept. 10
when Mabbott's ex-wife,
Teresa Anne Howe, was
granted interim custody of their children
pending a trial on the issue of Howe's access to
the kids.
But Christie said Mabbott was
not served notice of the application and didn't
even know about the court hearing. When Mounties
phoned Mabbott on Sunday afternoon to tell him
he had to turn over his three children Jared,
13, Taya, 9, and Ashley, 8 - to his ex-wife,
Mabbott refused.
Police issued a warrant the
next day.
Yesterday, Christie said
issues of access were settled in court and
Mabbott and Thomson were allowed to return to
their home in Alberta, where the children are
staying. The family had moved from Williams Lake
to Alberta about three weeks ago because of
Mabbott's work.
Christie said he is
considering a lawsuit against Williams Lake RCMP,
who issued a press release Monday alerting the
public that police were concerned about the
children's safety and were looking for
information on Mabbott's whereabouts.
Christie said a suggestion
that Mabbott may harm his children was
"totally unnecessary ... it
created alarm. It was both unjustified and
highly defamatory." |

It is now being reported on CTV News that Mel
Mabbot "WAS NOT WANTED ON WARRANT AS
REPORTED BY THE RCMP."
The RCMP lied to protect their stupidity, in the
press. The real truth is now coming out...
Mabbot showed up at the SCBC Victoria to
surrender in the company of a lawyer, Doug
Christy. Turns out,
the hearing was held and
they had failed to find him with notice, and as
is the practice at the SCBC, they carried on
without him, and in his absence transferred
custody to the mother. There was no warrant
issued by the court, it was only a lie told by
the RCMP to effect their unlawful policies and
to help beat up on fathers and help remove their
children from them".
The court in Victoria is reported to have
scheduled a trial spring next year, and Mabbot
retains custody of his children in the interim.
They now live in Alberta.
